TINJAUAN YURIDIS TERKAIT PENGAKUAN DAN PENGESAHAN ANAK LUAR KAWIN MENURUT HUKUM POSITIF (Studi Putusan Nomor 45/Pdt.P/2021/PN Bli)

Penelitian ini bertujuan untuk (1) mengkaji dan menganalisis tinjauan yuridis terkait pengakuan dan pengesahan anak luar kawin dalam menentukan kedudukan hukum seorang anak menurut hukum positif dan (2) menganalisis mengenai kedudukan hukum anak luar kawin yang telah disahkan berdasarkan Putusan Pengadilan Nomor 45/Pdt.P/2021/PN Bli. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis normative. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan dan pendekatan kasus. Sumber bahan hukum yang digunakan adalah bahan hukum primer dan bahan hukum sekunder yang diperoleh kemudian dianalisis menggunakan analisis kualitatif untuk memperoleh kesimpulan yang relevan dengan permasalahan penelitian ini. Hasil penelitian ini menunjukkan bahwa (1) Adanya ketidakselarasan pengaturan terkait kedudukan anak luar kawin berdasarkan Kitab Undang-Undang Hukum Perdata, Hukum Islam, Undang-Undang Perkawinan, Hukum Adat dan Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 dan (2) adanya perbedaan pendapat antara putusan Nomor 45/Pdt.P/2021/PN Bli dengan Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010. Meskipun terdapat perbedaan, berdasarkan putusan Nomor 45/Pdt.P/2021/PN Bli anak tersebut ditetapkan sebagai anak sah dari perkawinan para pemohon dengan segala akibat hukumnya.
