IMPLEMENTASI PERLINDUNGAN HUKUM TERHADAP ANAK KORBAN KEKERASAN SEKSUAL DI KOTA SINGARAJA

Penelitian ini bertujuan untuk (1) mengkaji dan menganalisis mengenai bentuk pelaksanaan perlindungan hukum terhadap anak yang menjadi korban kekerasan seksual di Kota Singaraja; dan (2) mengkaji dan menganalisis mengenai hambatan-hambatan yang dilalui dalam pelaksanaan perlindungan hukum terhadap anak sebagai korban kekerasan seksual di Kota Singaraja. Dalam penelitian ini, jenis penelitian yang digunakan adalah jenis penelitian hukum empiris dengan menggunakan sifat penelitian deskriptif. Adapun data dan sumber data yang digunakan yakni data primer dan data sekunder yang terdiri dari bahan hukum primer, bahan hukum skunder, dan bahan hukum tersier. Teknik pengumpulan data yang digunakan yakni teknik studi dokumen, teknik observasi, dan teknik wawancara. Teknik penentuan sampel yang digunakan adalah teknik non probability sampling dan penentuan subjeknya menggunakan teknik purposive sampling. Selanjutnya data yang diperoleh diolah dan dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa (1) bentuk pelaksanaan perlindungan hukum terhadap anak yang menjadi korban kekerasan seksual di Kota Singaraja berupa perlindungan secara pre-emtif, preventif, dan represif; dan (2) hambatan-hambatan yang dilalui dalam pelaksanaan perlindungan hukum terhadap anak sebagai korban kekerasan seksual di Kota Singaraja berupa hambatan yang berasal dari internal aparat penegak hukum maupun dinas terkait dan hambatan eksternal dari aparat penegak hukum maupun dinas terkait.
