EFEKTIFITAS PEMBERIAN DENDA TERHADAP KASUS TINDAK PIDANA NARKOTIKA

Kajian ini bertujuan mencaritahu efektifitas serta hambatan dalam pemberian pidana denda terhadap pelaku tindak pidana narkotika dan tindak pidana persekusor narkotika. Penelitian ini menggunakan metode deskriptif yuridis empiris guna melihat pelaksanaan sebuah hokum di lapangan. Hasil daripenelitian ini menunjukkan kurang efektifnya pemberian pidana denda. Hal ini dapat dilihat dengan masih banyakya terpidana kasus narkotika yang lebih memilih untuk mengganti pidana denda dengan pidana kurungan badan. Hal ini terjadi dikarenakan beberapa faktor seperti besarnya jumlah pidana denda yang dijatuhkan, faktor keadaan ekonomi terpidana, dan faktor adanya pidana pengganti yang relatif lebih ringan.
