EFEKTIVITAS PENERAPANSMALL CLAIM COURTDALAM PENYELESAIAN PERKARA PERDATA BAGI PELAKU UMKM DI KABUPATEN BULELENG

Abstract

Penelitian ini bertujuan untuk (1) mengkaji penerapansmall claim courtdalam penyelesaian perkara perdatadi Kabupaten Buleleng;dan(2)mengidentifikasi efektivitas penerapan small claim courtdalam menyelesaikan perkara perdata bagi pelaku UMKM di Kabupaten Buleleng. Metode penelitian yang dipergunakan adalah penelitian hukum empiris dengan teknik pengumpulan data menggunakan teknik wawancara, observasi, dan studi dokumen. Subjek dalam penelitian ini adalah pelaku UMKMdi Kabupaten Buleleng, Dinas Koperasi dan UKM Kabupaten Buleleng, dan Instansi Pengadilan Negeri Singaraja.Objek penelitian ini adalah penerapansmall claim courtdalam penyelesaian perkara perdata bagi UMKM di Kabupaten Buleleng. Teknik pengolahan dan analisis data dalam penelitian ini dilakukan secara kualitatif. Hasil penelitianmenunjukkan bahwa (1) penerapansmall claim courtdalam penyelesaian perkara perdata di Pengadilan Negeri Singaraja telah sesuai dengan PERMA No.2 Tahun 2015 tentang Tata Cara Penyelesaian Gugatan Sederhana. Sengketa yang masuk dari tahun 2015 hingga Agustus 2018 hanya tiga perkara Gugatan Sederhana yang diajukan ke PN Singaraja; (2) efektivitas penerapan  small claim courtdalam menyelesaikan perkara perdata bagi pelaku UMKM di Kabupaten Bulelengbelum maksimal baik dari substansi hukum maupun tingkat kesadaran hukum pelaku UMKM.
