Kontrak Build Operate Transfer Sebagai Sarana Mewujudkan Kesejahteraan Rakyat

Pembangunan fasilitas dengan menggunakan sistem kontrak Build Operate and Transfer (BOT) mulai marak digunakan di Indonesia. Pembangan infrastruktur oleh pemerintah tersebut membutuhkan anggaran yang sangat besar sehingga membutuhkan kerjasama dengan swasta. Kerjasama melalui kontrak BOT merupakan model baru pembiayaan proyek, yang tidak hanya menguntungkan para pihak dalam kontrak tetapi juga kepentingan publik. Tujuan penelitian ini dimaksudkan untuk memberikan gambaran penyelenggaraan kontrak BOT di Indonesia dan untuk mengetahui bagaimana kontrak BOT menjadi sarana mewujudkan kesejahtraan rakyat. Metode penelitian yang dipakai dalam penelitian ini bersifat doktrinal yaitu menggunakan metode penelitian hukum normatif (normative legal research). Hasil dari penelitian ini menunjukan bahwa kontrak BOT merupakan kontrak antara pihak pemerintah dan sektor swasta untuk membangun proyek infrastruktur beskala besar yang memiliki dampak postif bagi rakyat. Prinsip kebebasan berkontrak yang diterapkan dalam kontrak BOT merupakan implementasi dari Hak Asasi Manusia (HAM) sebagai sarana mewujudkan kesejahteraan rakyat.
