ANALISIS YURIDIS TERHADAP PERATURAN PEMERINTAH PENGGANTI UNDANG-UNDANG NOMOR 2 TAHUN 2022 TENTANG CIPTA KERJA
Abstract
The title of this research is "Judicial Analysis of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation". The research problem is "What is the Juridical Analysis of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation?". Meanwhile, the aim of this research is "to find out the Juridical Analysis of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation". The results of this research contain basic conclusions from the beginning of the process of forming Law no. 11/2020 is not in accordance with the principles, procedures, methods, processes and mechanisms for forming statutory regulations. The things mentioned above are directly proportional to the issuance of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation, giving rise to further controversy. With the issuance of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation, there are subjective reasons from the law makers, not objective ones. Shortly after the issuance of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation, a number of Petitioners submitted requests for formal and material review of the Perppu to the Constitutional Court (MK). The initial hearing was to examine petitions Number 5/PUU-XIX/2023 and Number 6/PUU-XIX/2023 in the case of reviewing Perppu 2/2022 concerning Job Creation.
