Tulisan ini akan membahas bagaimana kerahasiaan bank syariah di Indonesia sesuai dengan hukum yang berlaku dan bagaimana hal itu diterapkan di lapangan. Penelitian ini merupakan penelitian deskriptif yang memberikan gambaran hukum kerahasiaan bank syariah. Hasil penelitian menunjukkan bahwa kerahasiaan bank syariah: a. Informasi mengenai investor; b. Kewajiban bank dan pihak terafiliasi untuk menegakkan kerahasiaan investor; c. Pelanggan kerahasiaan bank informasi dapat dibuka untuk tujuan tertentu. Pengecualian syariah kerahasiaan bank untuk tujuan berikut: a. investigasi kriminal pajak; b. Keadilan dalam kasus pidana; c. Pemeriksaan dalam kasus perdata; d. Pertukaran informasi antara bank; e. Menuntut investor klien; dan f. Pewaris sah untuk memperoleh gambaran simpanan nasabah.
