Abstract

Pendekatan sistem hukum saat ini, lebih cenderung pada pendekatan keadilan restoratif. Kerangka pendekatan keadilan restoratif, akar nilai yang diusung lahir dari nilai-nilai tradisional. Dalam masyarakat tradisional dikenal nilai-nilai seperti nilai keseimbangan, keharmonisan serta kedamaian dalam masyarakat. Tulisan ini hendak mengkaji nilai-nilai dalam peradilan adat Nias (kearifan lokal Nias) kaitannya dengan peradilan dengan pendekatan keadilan restoratif. Studi kasus khususnya dalam penyelesaian perkara pelecehan terhadap perempuan (kasus Kadali) dan telah menjalani sidang adat pada 19 Oktober 2015. Nilai-nilai yang terkandung dalam kearifan lokal Nias (khususnya peradilan adat Nias) kaitannya pada peradilan pidana berbasis keadilan restoratif yakni keharmonisan, kedamaian dan keseimbangan. Penyelesaian kasus Kadali menjadi contoh penting, bagaimana konflik dapat diselesaikan dengan mempertemukan kepentingan korban, pelaku dan masyarakat. Menggunakan kearifan lokal yang ada, bertujuan mengembalikan keseimbangan tatanan masyarakat, yang sempat rusak dan terganggu, kembali ke keadaan semula (restituo in integrum). Penyelesaian konflik itu sesuai dengan hakikat keadilan restoratif (restorative justice).
